Red Sole or Red Soul?

Ask a fashionista what red soles on shoes mean and they’ve got two words for you: Christian Louboutin.
On the other hand, ask your guy what red soles mean and they’ll probably answer: dirty shoes...

It's Christian Louboutin's brand identity and it's no surprise to many that they've attempting to sue other shoe brands for imitating their red soles. But it does seem slightly outrageous that they believe they can copyright the colour red on shoes!
Recently Christian Louboutin took YSL to court over the fact that YSL have a red shoe in their 2010 range which conflicts with Christian Louboutin's red shoe soles identity.

Well their lawyers are back from court and it doesn't look good as the judge said at the last court date - "I doubt you can trademark a color"...

To me the shoes look nothing alike, so I have no idea why Christian Louboutin is making a fuss here, it's not like they need the publicity. But what do you think? Should they be allowed to sue someone over a colour?
